Estate Tax Abolition.

📣 ESTATE TAX AMNESTY vs. ESTATE TAX ABOLITION — What Every Filipino Family Should Know (2025 Update)

(Follow-up explanation based on thousands of comments from my previous viral post)

Over the past 24 hours, I received an overwhelming number of comments from Filipinos nationwide. Many families are confused, frustrated, or hopeful about the proposed changes in the estate tax law—especially with the discussions on Amnesty Extension and Estate Tax Abolition.

Let’s clarify everything in simple terms:

🔵 1. ESTATE TAX AMNESTY — What It Means

The Estate Tax Amnesty allows families to settle old estate tax obligations with:

No penalties

No interest

No surcharge

Lower tax computation (6%)

✔ This is good for families who want to clean up titles, transfer inherited properties, or prepare for future sale.
✔ House Bill 6614 proposes extending the amnesty until December 31, 2028.

But Amnesty still requires paying the estate tax.

🔵 2. ESTATE TAX ABOLITION — A Different Proposal

Separate from the amnesty extension, some lawmakers have filed bills to ABOLISH the estate tax entirely, such as:

📌 HB 6535 — Estate Tax Abolition Act of 2025
📌 Proposals to tax inheritance ONLY upon sale, not before transfer
📌 Authors include: Rep. Joey Salceda & Rep. Rachel “Cutie” Del Mar

If approved, this means:

✔ No more estate tax at the time of inheritance
✔ Families can transfer titles without paying a large tax upfront
✔ Government collects tax only when the property is eventually sold

This is why many people online say:
“Just abolish it. It’s double taxation.”

🔵 3. Why Many Filipinos Struggle With Estate Tax

Based on the comments:

Parents already paid taxes during their lifetime.

Heirs often cannot afford the estate tax.

Titles remain in the name of grandparents for 20–40 years.

Properties cannot be sold or developed due to “deadlock titles.”

Families are forced to borrow just to pay taxes.

This is a real, nationwide burden affecting millions.

🔵 4. What Happens If You Do NOT File Estate Tax

Under the current law (TRAIN):

Penalties accumulate

Interest applies

You cannot legally transfer or sell the property

Properties remain “frozen” for decades

This leads to family conflict, lost opportunities, and legal problems.

🔵 5. So What Should Families Do NOW?

While waiting for Congress and the Senate to decide:

✔ If you NEED the title transferred soon →

Amnesty is the fastest legal option.

✔ If you CANNOT afford the estate tax →

Wait and monitor the Abolition bill’s progress.

✔ If you want to understand your options →

🟦 IMPORTANT REMINDER
