LEGAL EXPLAINER | Can you file a case even without a lawyer?

YES. You absolutely can. Isa sa mga pinaka-karaniwang dahilan kung bakit ayaw o natatakot magreklamo ang tao ay ito:

"Wala akong pera para sa abogado."

But here's the truth that many Filipinos don't know: You do NOT always need a lawyer to file a case.

Walang batas sa Pilipinas na nagsasabing kailangan mo munang kumuha ng abogado bago ka makapagsampa ng kaso. Ang mahalaga ay may karapatan kang ipaglaban at may proseso ang batas para doon.

Ibig sabihin, puwede ikaw mismo ang gumawa ng complaint, pumirma rito, at mag-file nito sa tamang opisina o korte.

Hindi puwedeng tanggihan ang reklamo mo dahil lang wala kang abogado. The right to be heard does not depend on how much money you have.

✅️ Mga Sitwasyon Kung Saan Karaniwang Pinapayagan Ito

1. Barangay Proceedings

Sa barangay conciliation, mediation, at arbitration, hindi talaga kailangan ang abogado. Ito ay sadyang ginawa para maging mabilis, simple, at abot-kaya para sa ordinaryong mamamayan.

2. Small Claims Court

Sa small claims cases (up to 1M pesos), bawal pa nga ang abogado by rule. This system exists so ordinary people can collect small debts without spending more money on legal fees. Mabilis, diretso, at hindi komplikado.

3. Labor Cases (NLRC / DOLE)

Sa labor cases, employees and employers are allowed and even encouraged to appear without lawyers. Bakit? Dahil ang labor law ay nakabatay sa social justice. Hindi dapat maging hadlang ang kahirapan para maipaglaban ang karapatan sa sahod, benepisyo, o trabaho.

4. Criminal Complaints (before the prosecutor)

Kung ikaw ay biktima ng krimen, puwede kang personal na mag-file ng:
-complaint-affidavit,
-supporting affidavits, at
ebidensya.

Practical tip: Puwede kang humingi ng tulong sa police investigator sa police station ng lugar kung saan nangyari ang krimen. Tinutulungan nila ang mga complainant sa paggawa ng affidavits at pag-endorse ng kaso sa prosecutor's office.

💥 At mahalagang tandaan ito: Hindi mo kailangang mag-hire ng private lawyer para usigin ang kriminal na kaso.

Once the case is filed, ang DOJ prosecutors ang hahawak ng kaso para sa People of the Philippines, kasama na ang interes ng private offended party.

5. Kung ikaw naman ang sinampahan ng criminal complaint before the prosecutor's office, you can avail of the services of the Public Attorney's Office (PAO) kung wala kang pambayad sa abogado. Need mo lang mag-submit ng certificate of indigency to qualify for their assistance.

✅️ Paano Kung Kailangan ng Legal Assistance Habang Nagpapatuloy ang Kaso?

Dito pumapasok ang mismong Konstitusyon. Article III, Section 11 of the 1987 Constitution states:

"Free access to the courts and quasi-judicial bodies and adequate legal assistance shall not be denied to any person by reason of poverty."

Sa madaling salita: Hindi puwedeng ipagkait ang hustisya dahil mahirap ka. This is a constitutional guarantee grounded in social justice and equality. The State is obligated to make justice accessible, especially to those who cannot afford it.

✅ ️Available Free Legal Assistance

1. Public Attorney’s Office (PAO) provides free legal representation to indigent persons in criminal, civil, labor, and administrative cases, subject to reasonable indigency requirements.

2. IBP Legal Aid programs across the country also offer free legal advice and assistance through volunteer private lawyers.

3. Starting January 1, 2025, the Unified Legal Aid Service (ULAS) strengthens this even further. The Supreme Court now requires covered lawyers and law firms to render mandatory pro bono legal services, meaning more Filipinos will have access to free legal help whether for advice, affidavit preparation, or actual court representation.

Justice in the Philippines is not reserved for those who can afford lawyers. You can file a case even without one. And if at some point you truly need legal assistance, the law and the Constitution ensure that help is available.

Kung may paglabag sa karapatan mo, huwag hayaang katahimikan ang manaig dahil lang sa kakulangan ng pera.

Justice is a right, not a luxury.
