Malinaw.

DEVELOPING: AZCUNA VS. PANGANIBAN!

“If you cannot get the 16, it's an acquittal. A judgment of acquittal will be entered.”

Aniya:

“A judgment of acquittal will be entered, not because of a vote for acquittal prevailing, but simply because of failure to get the 16 votes minimum necessary in order to convict.”

At pagkatapos, sinabi niya ang linyang siguradong pag-uusapan:

“It’s a price we pay for the internal check of a supermajority threshold, that there are occasions when accountability through impeachment will fail.”

“Fairness can be rendered by two-thirds of those present. It’s not necessary that 16 should vote in favor because it’s impossible to get sixteen.”

Mas matindi pa:

“Fairness cannot be rendered nugatory simply because of circumstances beyond the control of our people.”

“Our people deserve still to be given justice because the 15 can still act and render justice and be able to discipline whoever is to be disciplined.”

“I believe that the senators have been empowered by our Constitution to act, and our Constitution trusts their judgment.”

“If our Constitution, therefore, our people who ratified the Constitution wanted the Supreme Court to settle this question, then it should have provided that the Constitution should be the tribunal that will decide impeachment cases.”

AZCUNA: “PRICE WE PAY.”

PANGANIBAN: “OUR PEOPLE DESERVE STILL TO BE GIVEN JUSTICE.”
