A hostile witness is a person called to testify in court by a party, but whose testimony is uncooperative, evasive, or openly favorable to the opposing side. Bakit hiniling ng prosecution na ideklarang hostile witness si Gina Acosta? At bakit naging advantage pa ito sa prosecution?

Normally, kapag sarili mong witness, hindi mo puwedeng i-lead. You ask open-ended questions and allow the witness to tell the story. Pero kapag dineklara ng court na hostile or unwilling witness, puwede nang gumamit ng leading questions.

At malaking bagay iyon. Bakit? Dahil imbes na:

"Sino ang nag-utos sa iyo na ilabas ang pera?"

at bigyan ang witness ng pagkakataong umiwas, magpaligoy-ligoy, o magbigay ng ibang version, puwede nang itanong nang diretso:

"Si Vice President Sara Duterte ang nag-utos sa iyo na i-release ang 125M pesos, tama?"

Yes or no. Diretso. Walang paligoy-ligoy.

At ano ang nakuha ng prosecution kay Acosta? Among the significant admissions:

-Si Acosta mismo ang nag-encash ng 125M.

-Buong 125M ay inilabas bilang cash.

-Inilagay ang pera sa apat na bags.

-Ibinigay niya ang cash kay Col. Raymund Dante Lachica.

-Sinabi niyang ginawa niya ito dahil iyon ang utos ng kanyang head of agency, si Sara Duterte.

-Si Lachica ay security officer, hindi Special Disbursing Officer.

-Nang tanungin kung anong rule sa Joint Circular No. 2015-01 ang nag-authorize sa isang security officer na gumastos ng confidential funds, wala siyang maisagot.

-At kinumpirma rin niya na wala ang pangalan ni Lachica sa relevant OVP documents submitted to COA.

From the standpoint of trial strategy, malaking bagay ang hostile-witness ruling because the prosecution was able to create a very simple chain:

Sara Duterte.

SINO ANG NAG-WITHDRAW?

Gina Acosta.

ANO ANG NANGYARI SA 125M?

Hindi.

ANONG RULE ANG NAG-AUTHORIZE SA KANYA NA GUMASTOS NG CONFIDENTIAL FUNDS?

Acosta could not identify one.

NASA COA DOCUMENTATION BA ANG PANGALAN NI LACHICA?

Wala.

And that is why the prosecution wanted Acosta declared hostile. Hindi kailangan ng prosecution na maging "kakampi" nila si Acosta. Kailangan lang nilang makuha ang admissions na mahalaga sa kaso.

The hostile-witness ruling gave them the ability to lead, confront, and lock in those answers.
